Training Repayment Agreement
This agreement is made on 24 October 2026 between Clearpath Accounting LLP (the "Employer") and Hannah O'Neill (the "Employee"), employed as Audit Associate.
1. The training
The Employer will pay for the Employee to complete the ACCA professional qualification, all remaining exam papers, provided by Kaplan Financial (the "Training"). The cost to the Employer is GBP 6,400, covering tuition, exam fees and study materials (the "Training Cost").
2. Support
The Employer will also give 10 paid study days a year while the training continues.
3. Repayment if the Employee leaves
If the Employee resigns, or is dismissed for gross misconduct, within 24 months after the training is completed, the Employee will repay part of the Training Cost on this scale: 100% if the employee leaves within 6 months, 75% within 12 months, 50% within 18 months and 25% within 24 months. The amount is measured from the date the Training is completed, or from the date the Employee stops attending it if earlier.
4. When no repayment is due
No repayment is due if:
- the Employer dismisses the Employee for any reason other than gross misconduct, including redundancy;
- the Employee resigns because of a serious breach of contract by the Employer;
- the Employee leaves because of ill health, supported by medical evidence; or
- the Employer decides to withdraw the Training.
5. How repayment is made
The Employee agrees that any repayment due may be deducted from their final pay, to the extent the law allows and never so as to reduce pay below any statutory minimum. Any balance is payable within 60 days of leaving, or by instalments agreed in writing.
6. Only actual costs
The repayment will never exceed the Training Cost actually paid by the Employer, less any amount the Employer recovered from a grant or tax relief.
7. Governing law
This agreement is governed by the law of England and Wales.

About the Training repayment agreement template
When an employer pays for an expensive course, it is reasonable to ask for some of the money back if the employee leaves straight afterwards. A training repayment agreement, sometimes called a clawback, sets that out in advance, so nobody is surprised.
The key to a fair, and enforceable, agreement is proportion. This template repays only the actual cost of the training, never a penalty, and the amount tapers to zero over a stated period, reflecting the value the employer has already received. It does not apply if the employer dismisses the employee for reasons other than misconduct, or if the employee leaves because of the employer's serious breach. Deductions from final pay are made only with the employee's written agreement, given here, and never below the minimum wage where that applies.
Sign it before the training starts and before the employer pays, which matters legally in many countries and is fairer in every one.

Questions
Is a training repayment clause enforceable?
Usually, if it is agreed in advance, limited to genuine costs, reduces over time, and is reasonable in length. A clause that works as a penalty, or traps people in a job, is less likely to be upheld.
Can the employer deduct the repayment from final wages?
Only where the law allows and with the employee's prior written agreement, which section 5 records. Deductions must not take pay below the legal minimum.
What if the employee fails the course?
This template does not require repayment for failing; it applies only when the employee leaves within the repayment period. Add a condition if you need one, and keep it fair.
